In New Brunswick – Canada’s only bilingual province – there is a constitutional challenge to the appointment of a unilingual Lieutenant Governor. The Centre for Public Law held a panel discussion on the case last week. My comments, which relate to the justiciability of prime ministerial advice to the Governor General and the justiciability of decisions taken pursuant to the Constitution Act, 1867, begin at around 50 minutes in. Preceding me are Prof Stéphanie Chouinard, a political scientist, Jennifer Klinck and Darius Bossé (Juristes Power Law) who are arguing the case for the applicants and Prof Marie-France Fortin, a law professor who is an expert on the Crown. There is also a lively question and answer period.
